Charter for the MCC Advisory Council

MCC Advisory Council (“Advisory Council”)

Authority

The Advisory Council has been renewed under agency authority pursuant to and in accordance with the provisions of the Federal Advisory Committee Act (FACA), as amended.

Objectives and Scope of Activities

The Advisory Council shall serve MCC in a solely advisory capacity and provide insight regarding i) innovations in relevant sectors including technology, infrastructure and blended finance; ii) perceived risks and opportunities in MCC partner countries; and iii) evolving approaches to working in developing country contexts. The Advisory Council will provide a platform for systematic engagement with the private sector and contribute to MCC’s mission – to reduce poverty through sustainable economic growth.

MCC will use the advice, recommendations, and guidance from the Advisory Council to i) inform MCC’s compact and threshold development and implementation process and ii) broaden and deepen public and private sector partnerships for more impact and leverage.

Description of Duties

The Advisory Council will provide advice to MCC on issues including:
  1. Innovative, scalable, and sustainable market-based approaches to economic growth.
  2. Effective and efficient use of technology, and commercially viable development solutions.
  3. Leveraging private investment and partnerships to advance development objectives in compact countries.
  4. Perceived private sector risks and opportunities in MCC partner countries.
  5. Project development and implementation challenges and opportunities; particularly where public and private resources can be effectively deployed to achieve sustainable development outcomes.
  6. Policy, institutional, and regulatory reforms necessary to enable private sector growth in MCC partner countries.
  7. Areas of new opportunity for MCC, including maximizing the impact of regional investment authority.
The duties of the Advisory Council are solely advisory and any determinations to be made or actions to be taken based on Advisory Council advice shall be made or taken by appropriate officers of MCC.

Agency or Official to Whom Council Reports

The Advisory Council will report to the Vice President of the Department of Compact Operations (DCO).

Support

DCO will provide administrative support for the Council.

Estimated Annual Operating Costs and Staff Years

Annual operating costs include meeting expenses, staff salary and benefits, meeting supplies, as DCO deems necessary. Depending on the frequency of meetings, the annual operating costs of establishing and maintaining the Advisory Council is estimated to be approximately $55,000.

Designated Federal Officer

The Designated Federal Officer (DFO) is a permanent part-time or full-time federal employee who will be appointed by the Vice President of the Department of Compact Operations and shall ensure compliance with FACA and its implementing regulations. The DFO will approve or call all of the MCC Advisory Council and subcommittee meetings, prepare and approve all meeting agendas, attend all Council and subcommittee meetings, adjourn any meeting when the DFO determines it to be in the public interest, and chair meetings when directed by the agency head. Alternative DFOs may be appointed.

Estimated Number and Frequency of Meetings

The Advisory Council will meet at least two times a year in Washington, DC or via video/teleconferencing.

Duration

The Advisory Council will serve indefinitely, on a continuing basis, subject to biennial renewal as required under the FACA.

Termination

In accordance with the FACA, the Advisory Council will terminate two years from the date of filing this Charter, unless the Charter is renewed prior to termination.

Membership and Designation

The Advisory Council shall be comprised of no more than 25 members who are independent of the agency and are recognized experts in their field, business leaders, innovators, and thought leaders. Members will serve in a representative capacity, representing the views and interests of their industry or area of expertise, and not as Special Government Employees. All members shall serve without compensation. All members may serve no more than two terms or four years.

Subcommittees

The Advisory Council may, with agency approval, create subcommittees as necessary and consistent with the Charter. These subcommittees must report to the Advisory Council and not directly to MCC or any of its employees.

Record Keeping

The records of the Advisory Council and any subcommittees shall be handled in accordance with General Records Schedule 6.2. The records will be available for public inspection and copying, subject to the Freedom of Information Act, 5 USC 552.
